Costs
How much does a protection order cost in South Africa?
There is no court fee simply to apply for a statutory protection order and you do not have to appoint an attorney. Professional fees arise only if you choose legal assistance for advice, drafting, preparation, representation, opposition or enforcement work.
- You may bring the application personally.
- An attorney is optional, not a condition for applying.
- Legal fees depend on the work and complexity of the matter.
- Ask for the scope and estimated fees before instructing a practitioner.
What attorney fees may cover
Legal work may include consultation, reviewing evidence, drafting or settling affidavits, preparing annexures, correspondence, court attendance, opposition and advice following a breach.
When professional help is most useful
Advice is particularly valuable where the facts are disputed, the respondent is likely to oppose, urgent relief is sought, children or a shared residence are involved, or the protection-order matter overlaps with criminal or family proceedings.
