How to oppose a protection order in South Africa
Opposition is about answering the case placed before the court. Focus on the material allegations, the evidence and the specific restrictions the applicant asks the court to make final.
Preparing your response
Build the defence around the actual application
The strongest response is specific, organised and supported by objective material where available.
Identify what is actually disputed
Read the application and isolate the allegations that matter to the order sought. Do not bury the response in side disputes.
Answer each material allegation
State clearly what is admitted, denied or requires explanation. A bare denial is less useful than a factual answer supported by records or witnesses.
Build your chronology
Put the relevant events in sequence so the court can see where the parties' versions agree and where they diverge.
Use complete evidence
Keep full conversations and original records where possible. Context often matters more than a single screenshot.
Address the terms sought
Deal with the practical restrictions the applicant wants made final. Explain why particular terms are unnecessary, unworkable or should be narrowed where that is your case.
Prepare for the return date
Know the outcome you ask the court to make and organise the papers so the disputed issues can be dealt with efficiently.
